Deforestation and forest degradation contribute to the global climate crisis in multiple ways, with the consumption of certain critical raw materials by the EU being a significant driver. The European Green Deal therefore forms the basis for the EUDR (European Deforestation Regulation), which will come into effect on December 30, 2025. This regulation (EU) 2023/1115 of the European Parliament and Council addresses the supply of specific raw materials and products linked to deforestation and forest degradation on the Union market and their export from the Union, while repealing Regulation (EU) No. 995/2010.

The EUDR delegates a national authority in each EU Member State, which is responsible for implementing and monitoring compliance with the obligations. A complete list of all national authorities can be accessed here. Companies that fail to comply with the regulations face fines of up to 4% of their annual EU turnover, as well as the seizure of products and income. This carries significant implications for businesses, including supply chain disruptions and challenges related to overall resource availability.

Are you affected?

The scope of the EUDR extends to numerous industries such as mechanical engineering, construction, caravan and automotive sectors, sanitary ware, furniture, as well as packaging and publishing industries, as their products fall within the regulation’s scope. The seven raw materials primarily affected are:

as well as all products subsequently manufactured from these raw materials, such as paper, cardboard and pallets, furniture and wood products, pneumatic tires and hoses made of rubber, or leather goods.

The EUDR fundamentally distinguishes between two types of affected actors: operators and traders. Depending on the size of the company, they must fulfill different obligations and are therefore classified into one of the following company categories, with at least two of the three criteria needing to be met:

What challenges lie ahead for you?

The EUDR obliges companies to fulfill a wide range of due diligence requirements. This includes, in particular, the obligation to ensure that the products a company places on the market are produced free from deforestation and forest degradation. Additionally, geolocation data must be collected for all land on which relevant raw materials are produced to demonstrate that no forest areas have been damaged or converted.

These requirements pose significant challenges for companies, as the newly necessary data to meet due diligence obligations are often unavailable and difficult to obtain due to complex global supply chains.
